Terms and Conditions

By purchasing the Brand Evaluation Package (Service) or using the website https://fizzydrink.eu (the “Website”), you (“Client” or “you”) agree to be bound by these Terms and Conditions.

1. Service Description

1.1 The Brand Evaluation Package is a one-time digital service priced at €397 (net).

1.2 After successful payment, the Client completes a questionnaire and may provide additional materials.

1.3 Using the submitted information and publicly available data, Fizzy Drink S.R.L. records an original video evaluation of approximately 60 minutes covering (among other topics):

Current brand perception and messaging
Competitor and market-segment analysis
Technical evaluation of logo, colour palette, typography, positioning, and overall brand identity

1.4 The Client receives a private download link. The link remains active for 90 days from delivery. After this period we are under no obligation to maintain access or provide additional copies.

2. One-Time Purchase – No Ongoing Obligation

2.1 The purchase is a single transaction. It does not create any continuing relationship, obligation to provide further services, or exclusivity arrangement.

2.2 No specific business outcome or result is guaranteed.

3. Intellectual Property and Licence

3.1 The video and all related content remain the exclusive property of Fizzy Drink S.R.L. Copyright is not transferred.

3.2 The Client receives a limited, non-exclusive, non-transferable, revocable licence to view, download, and share the video internally within their organisation or direct team.

3.3 The Client is expressly prohibited from:

Publishing or displaying the video publicly (including social media, presentations, websites, etc.)
Selling, renting, sublicensing, modifying, editing, or creating derivative works
Removing or altering any copyright notice or watermark

Any unauthorised use constitutes copyright infringement and may lead to immediate termination of access and legal action.

4. Pricing and Taxation

4.1 Price: €397 (net). No shipping or handling fees apply.

4.2 Fizzy Drink S.R.L. is not VAT-registered.

EU business customers (with or without VAT ID): 0 % VAT – reverse charge applies (invoice note: “Reverse charge”)
Consumers and non-EU customers: no VAT charged

5. 30-Day Money-Back Guarantee

5.1 If the Client is not satisfied with the delivered video, a full refund may be requested within 30 calendar days of delivery.

5.3 Upon refund, access to the video will be revoked.

6. Shipping & Delivery of Service

6.1 Shipping: There is no physical delivery of the service and as a result no shipping or handling charges.

6.2 Delivery of Service: The Brand Evaluation Package video is typically delivered within 5-7 business days after registration (form completion) and payment. See section 1.4 for the details regarding the video delivery conditions.

7. Privacy

The collection and processing of personal data submitted through the questionnaire or otherwise is governed by our Privacy Policy & GDPR.

8. No Warranties – Limitation of Liability

8.1 The service is provided “as is” without warranties of any kind, express or implied.

8.2 To the fullest extent permitted by law, Fizzy Drink S.R.L. shall not be liable for indirect, incidental, consequential, or punitive damages, or any loss of profit, revenue, data, or goodwill.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania.
Any dispute shall be first submitted to the NATIONAL AUTHORITY FOR CONSUMER PROTECTION before being submitted to any of the Country’s competent Courts.

10. Changes to These Terms

We may update these Terms & Conditions at any time. The new version will be posted here with an updated effective date. Continued use of the Website or service after changes constitutes acceptance.
